Foshay Company stock, to the purchase of which from itself as administrator de bonis non of the estate of R. J. Rosenfeldt as an investment for the Julia A. Rosenfeldt estate it obtained the consent of the beneficiaries and the authorization of the probate court, were worthless, and that it was negligent, in that upon being appointed trustee under the will of Julia A. Rosenfeldt it failed to recover from itself as executor of her will the $13,320 paid for said worthless stock, justified surcharging the trustee's account said sum.
